Contested Divorce at Bruce R Bekritsky, Attorney at Law
A contested divorce is one in which the parties cannot agree, either about getting divorced or about the terms of the divorce.
Contested divorces are a common scenario, given that there are a variety of sensitive issues to be worked out between a couple that has decided to break their union. Some of these issues include:
- Custody of children
- Child support
- Division of assets and property
- Allocation of debts
- Alimony
Where the partners cannot come to an agreement, even with the aid of their respective divorce attorneys, the couple must then take their issue(s) to a court to be decided.
If the divorce involves minor children, an attorney for the children, also called a law guardian, will be assigned to represent them. He or she will conduct interviews and recommend who will receive custody of the child(ren) and what type of custody is in the best interests of the child(ren). If there is a disagreement with the law guardian's recommendation, your attorney will advise you and help protect your legal interests. He or she will conduct interviews and recommend who will receive custody if the child(ren), what type of custody is in the best interest of the child(ren) and the amount of child support to be paid. In the event that there is an objection to the ruling by one of the parties (the spouses getting the divorce), you will want to consult your divorce attorney to represent your legal interests.
While facing divorce can be a difficult situation, Bruce R Bekritsky is here to help you.
